Welcome to the Refresh NTX portal. These Terms of Service (“Terms”) are an agreement between you and Refresh North Texas, a 501(c)(3) nonprofit organization (“Refresh NTX,” “we,” “our,” or “us”). By creating an account, enrolling a student, or otherwise using the portal, you agree to these Terms.
If you do not agree, please do not use the portal.
Who Can Use the Portal
The parent-facing portal is intended for parents and legal guardians of students attending participating North Texas schools. You must be at least 18 years old to create an account. The school-facing portal is intended for authorized school and district staff.
You agree to provide accurate information about yourself and your student, and to keep that information up to date.
Accounts and Sign-In
You are responsible for keeping your sign-in method (magic-link email or Google account) secure. Do not share access to your account with anyone else. Notify us promptly at info@refreshntx.org if you suspect your account has been used by someone else.
Acceptable Use
You agree not to:
- enroll a student you are not the parent or legal guardian of, or submit information that is false, misleading, or fraudulent;
- attempt to access accounts, records, or features that do not belong to you;
- interfere with or disrupt the portal, introduce malware, or probe for vulnerabilities without our written permission;
- use the portal for any unlawful purpose or in violation of any applicable law or school-district policy.
We may suspend or terminate access for any account that violates these Terms or that we reasonably believe is being misused.
Program Participation
Refresh NTX provides period and hygiene products to enrolled students at no cost, subject to availability, school participation, and grant funding. Enrollment does not guarantee any specific product, delivery date, or quantity. We coordinate distribution with each student's school and district, and schools control how and when products are handed out to students on their campus.
Your Content
You retain responsibility for the information you submit about yourself and your student. By submitting it, you grant Refresh NTX permission to use that information to operate the program as described in our Privacy Policy.
Our Content
The Refresh NTX portal, including its design, logos, text, and software, is owned by Refresh North Texas or its licensors and is protected by copyright and other laws. You may not copy, modify, or redistribute any part of the portal without our prior written permission, except to the limited extent necessary to use the portal for its intended purpose.
Service Availability
We work to keep the portal available and reliable, but we do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the portal at any time, with or without notice.
Disclaimers
The portal is provided “as is” and “as available.” To the fullest extent permitted by law, Refresh NTX disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the portal will meet your requirements, be secure, or be free of viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by law, Refresh NTX and its directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the portal. Our total liability for any claim related to the portal will not exceed one hundred dollars (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Termination
You may stop using the portal at any time and may request that we delete your household record by emailing info@refreshntx.org. We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms or if we discontinue the program.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Effective” date at the top of this page and, for material changes, notify enrolled parents by email. Your continued use of the portal after the effective date means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the portal will be resolved exclusively in the state or federal courts located in Texas.
